Berne City Councilman Mark Wynn will retain his seat on that panel, despite a Sept. 1 starting date as Adams County's Director of Building and Planning.
Berne City Attorney Jim Beitler on Friday said the Indiana Attorney General's office has ruled that Wynn would not violate "dual-office" guidelines contained in the Indiana Code by holding the two public offices.
In the weeks since it was announced that Wynn would succeed the retiring Neil Ogg as the county's building and planning director, there has been some question whether Wynn legally could continue to hold his seat on the Berne council while serving as director of the county office. The Indiana Code's "dual office" guidelines prevent one individual from holding two "lucrative" government office positions simultaneously, but Beitler on Friday said the state has determined that the two position do not meet the "lucrative" threshold.
