Burglary with injury and robbery occurred when Garcia and several others attacked an elderly Decatur woman in her home on February 14, 2008. Battery causing injury involved a jailer at the Adams County Jail, Mike Padgett, who was accidentally hit in one eye by Garcia as Padgett broke up a fight between Garcia and another inmate last November 17. Padgett is the son of Adams County Sheriff Chuck Padgett. Judge Schurger, who heard Adams County Prosecutor Chris Harvey say Garcia has been in trouble with the law since age 12 and has been in jail or on probation for more than six of the past seven years, handed down the following concurrent prison sentences: For burglary causing injury, 35 years, with 10 years suspended, leaving 25 years to serve. For robbery with a deadly weapon, 10 years to serve. For the 10 burglaries of storage units, 10 eight-year sentences (concurrent). For dealing in a sawed-off shotgun, 1.5 years to serve. For battery causing injury, the judge said a 1.5-year term is to be served after the 25-year overall sentence, thus making 26 1/2 years. In addition, Garcia must pay $328 in court costs and $250 in restitution, will be on probation for 10 years after release from prison, and must pay probation fees. He also must complete anger-management counseling, and cannot have any contact with the elderly female victim or the jailer he hit as long as he is on probation. For his part, Garcia said in court that he apologizes to the woman who was hurt in the February, 2008, assault and that he has had 16 months in jail to think about what he did.
