Trial is staying in Wells
A request by an Ossian man, charged with murdering a neighbor boy last July, to have his case moved outside of Wells County has been turned down by Wells Circuit Court Judge Kent Kiracofe.
The judge ruled that there has not been excessive publicity about the case and that an impartial jury could be selected at a trial.
Bruce Pond is accused of firing a gun toward a light on a dock on a pond at night on July 22. The shot killed four-year-old Jacob Michuda, who was fishing with his father.
Pond is also charged with unlawful possession of a firearm because of a domestic battery conviction.
The request to move the trial to another county was made by Pond's lawyer, Benjamin Nordmann of Fort Wayne.
Judge Kiracofe wrote in his opinion that the defense "failed to establish that prospective jurors could not render an impartial verdict."
The trial is scheduled to start on January 10.
